These Terms of Service ("Terms") govern your access to and use of the CallSec secure communication platform, including the website at callsec.si and the CallSec mobile applications (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.

Important: While CallSec implements end-to-end encryption, we make no guarantees regarding the absolute security of any communication. Encryption technology has inherent limitations. CallSec shall not be held responsible for any interception, decryption, or unauthorized access to communications, whether due to software vulnerabilities, user error, device compromise, or any other cause.

The CallSec application includes security features designed to protect your device and communications. By using the Service, you acknowledge that:

Device security features are provided as additional protective measures only. CallSec does not guarantee detection of all threats, including but not limited to: rootkits, zero-day exploits, advanced persistent threats, IMSI catchers, or sophisticated surveillance tools. Users should not rely solely on CallSec for their security needs. CallSec assumes no liability for any security breach or threat that goes undetected.

CALLSEC SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CALLSEC DOES NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE; (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED; (E) THE ENCRYPTION IS UNBREAKABLE; OR (F) THE SERVICE WILL PROTECT YOU FROM ALL SECURITY THREATS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM CALLSEC SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

You agree to indemnify and hold harmless CallSec, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

CallSec shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: natural disasters, wars, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, fuel, energy, labor, materials, telecommunications failures, infrastructure failures, hacking, cyber-attacks, government actions, or any other force majeure event.

The Service may interact with third-party services including but not limited to: push notification services (Firebase Cloud Messaging, Apple Push Notification Service), TURN/STUN relay servers, and certificate authorities. CallSec has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that CallSec shall not be responsible or liable for any damage or loss caused by your use of or reliance on any third-party services.

You are solely responsible for all content you create, transmit, or display through the Service. Due to end-to-end encryption, CallSec cannot monitor, review, or filter the content of your communications. CallSec bears no responsibility whatsoever for any content transmitted through the Service, including but not limited to: illegal content, defamatory statements, harassment, threats, intellectual property violations, or any other objectionable material. You agree to hold CallSec completely harmless from any claims arising from content transmitted through the Service.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. For material changes, we will make reasonable efforts to notify you through the Service or via email.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws of the jurisdiction in which CallSec operates. Any disputes arising from these Terms shall be resolved through the competent courts of that jurisdiction.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CallSec regarding the use of the Service and supersede any prior agreements or understandings.
