Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CallSec secure communication platform, including the website at callsec.si and the CallSec mobile applications (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

CallSec provides a secure, end-to-end encrypted communication platform that includes:

• Encrypted text messaging (one-to-one and group conversations)
• Encrypted voice and video calling
• Secure file sharing within conversations
• Multi-device session management
• On-device security features (threat detection, biometric lock, etc.)

3. Eligibility

You must be at least 16 years of age to use the Service. By using CallSec, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

• Accounts are created through an invitation or registration process managed by your organization's administrator
• You are responsible for maintaining the confidentiality of your account credentials, PIN, and authentication methods
• You must immediately notify your administrator of any unauthorized use of your account
• You are responsible for all activities that occur under your account

5. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Use the Service to transmit illegal, harmful, threatening, abusive, or otherwise objectionable content
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service, servers, or networks
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to distribute malware, viruses, or other harmful software
• Circumvent or disable any security features of the Service
• Use the Service for mass unsolicited communications (spam)
• Impersonate another person or entity
• Use the Service in violation of any applicable local, national, or international law

6. End-to-End Encryption

Important: While CallSec implements end-to-end encryption, we make no guarantees regarding the absolute security of any communication. Encryption technology has inherent limitations. CallSec shall not be held responsible for any interception, decryption, or unauthorized access to communications, whether due to software vulnerabilities, user error, device compromise, or any other cause.

7. Device Security

The CallSec application includes security features designed to protect your device and communications. By using the Service, you acknowledge that:

• The app may detect and alert you to potential security threats on your device (root access, screen recording, etc.)
• Certain features may be restricted on devices that fail security checks
• You are responsible for maintaining the physical security of your devices

Device security features are provided as additional protective measures only. CallSec does not guarantee detection of all threats, including but not limited to: rootkits, zero-day exploits, advanced persistent threats, IMSI catchers, or sophisticated surveillance tools. Users should not rely solely on CallSec for their security needs. CallSec assumes no liability for any security breach or threat that goes undetected.

8. Intellectual Property

• The Service, including its software, design, logos, and documentation, is the intellectual property of CallSec and is protected by applicable copyright and trademark laws
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose
• You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key points include:

• Message content is end-to-end encrypted and inaccessible to CallSec
• We collect only the minimum data necessary to operate the Service
• We do not sell your data to third parties
• Data is stored on servers in Europe in compliance with GDPR

10. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted access to the Service
• The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control
• We reserve the right to modify, suspend, or discontinue the Service (or any part of it) with reasonable notice

CallSec provides no uptime guarantees. The Service may be interrupted, suspended, or discontinued at any time without notice. CallSec shall not be liable for any damages, losses, or consequences resulting from service interruptions, outages, data loss during transmission, failed message delivery, dropped calls, or any inability to access the Service.

11. Account Termination

• You may request deletion of your account at any time by contacting info@callsec.si
• We may suspend or terminate your account if you violate these Terms
• Your organization's administrator may manage your account in accordance with their enterprise agreement
• Upon termination, your right to use the Service ceases immediately. Encrypted data on your devices remains under your control

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• CallSec shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• CallSec shall not be liable for any loss of data, loss of profits, or business interruption
• Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim
• CallSec assumes no responsibility for the content of messages, calls, or any data transmitted through the Service. Users are solely responsible for their communications and compliance with applicable laws
• CallSec is not responsible for any security breaches, data loss, unauthorized access, interception of communications, or any damages resulting from the use or inability to use the Service, even if advised of the possibility of such damages
• You use the Service entirely at your own risk. CallSec provides no guarantees regarding availability, reliability, or security of the Service

14. Indemnification

You agree to indemnify and hold harmless CallSec, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Force Majeure

CallSec shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: natural disasters, wars, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, fuel, energy, labor, materials, telecommunications failures, infrastructure failures, hacking, cyber-attacks, government actions, or any other force majeure event.

16. Third-Party Services

The Service may interact with third-party services including but not limited to: push notification services (Firebase Cloud Messaging, Apple Push Notification Service), TURN/STUN relay servers, and certificate authorities. CallSec has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that CallSec shall not be responsible or liable for any damage or loss caused by your use of or reliance on any third-party services.

17. User Content and Communications

You are solely responsible for all content you create, transmit, or display through the Service. Due to end-to-end encryption, CallSec cannot monitor, review, or filter the content of your communications. CallSec bears no responsibility whatsoever for any content transmitted through the Service, including but not limited to: illegal content, defamatory statements, harassment, threats, intellectual property violations, or any other objectionable material. You agree to hold CallSec completely harmless from any claims arising from content transmitted through the Service.

18. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. For material changes, we will make reasonable efforts to notify you through the Service or via email.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national laws of the jurisdiction in which CallSec operates. Any disputes arising from these Terms shall be resolved through the competent courts of that jurisdiction.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CallSec regarding the use of the Service and supersede any prior agreements or understandings.
